Buying a flat? NEW rules take effect today — here’s what changes (and why agents will hate it)
Real estate in Croatia has been expensive, nerves have been frayed, and agencies have been working under a law from 2007. As of July 7, 2026, that’s finally changing.
Amendments to the Real Estate Mediation Act bring stricter rules for agencies and stronger protection for buyers, sellers, and tenants. Here’s what you need to know.
1. Viewing a property no longer requires signing a contract
Remember when agencies demanded you sign a mediation contract just to view an apartment? That’s now illegal. The law now clearly distinguishes between viewing a listed property and using mediation services. You can walk in, look around, and walk out without signing anything.
2. Commission only payable under contract
Commissions can only be charged if a signed mediation agreement exists. Agencies can no longer charge “viewing fees” or demand payment without a proper contract in place.
3. “Licensed agent” isn’t a thing — check the registry
The term “licensed real estate agent” has no legal basis in Croatia. All agents must pass a professional exam, be employed by an authorized agency, and be registered with the Croatian Chamber of Commerce (HGK). Check the public registry before signing anything.
4. Agency directors can’t have a criminal record
Anyone convicted of certain criminal offenses is now banned from running a real estate agency. If someone is selling your €200,000 apartment, it’s reasonable to expect they’re not a convicted fraudster.
5. Mandatory liability insurance — higher amounts
Agencies must carry increased liability insurance. If they mess up — sell you a property with a fake owner, miss a legal issue in the contract — the insurance covers the damage.
6. Ethics code is now mandatory
The code of ethics, previously voluntary, is now a binding part of the law. Violations can lead to losing the license to operate.
7. No more fake listings
Agencies can only advertise properties they have a signed mediation contract for. No more “500 apartments listed, half don’t actually exist” situations on Njuškalo.
Practical tips before you buy
- Check the agency in the official HGK registry
- Don’t sign anything before reading and understanding it
- If asked to sign just to view a property — say no, the new law is on your side
- Ask for a written commission statement before signing
